THE FORMOSA GARDEN RULES

 If you’ve lived in the Garden for a few years, then you’ll be familiar with the few simple rules that have been created to make sure everyone has their chance to enjoy the relaxation and tranquillity that the Garden can offer.  If you’re new to the Garden, then this list should be self-explanatory.  Its purpose is simple – let’s respect each other’s right to enjoy the garden in peace.

Some general rules which everyone needs to know

We’re determined to preserve the Garden as a secure and safe environment. Its use is restricted to freeholders and to the authorised leaseholders and tenants who are living in properties which back onto the gardens and their accompanied guests or invited friends.

Noisy or disorderly conduct likely to disturb other residents is prohibited.  The volume of all forms of music, both within and around the garden, must be kept down.

None of the Garden’s property, including walls, gates, rails, seats, hosepipes, trees, plants, flowers & grass may be marked, cut or damaged.  The directors have the right to charge you individually for damage done.  We also don’t expect anyone to obstruct or damage any part of the Gardens or leave litter.  Parents or guardians will be held responsible for the cost of damage children do to communal plants or property.

Making alterations to your property

If you’re considering making any external alteration of any kind to your property, then you’ll need prior permission from the Directors of Formosa Amenity Ltd.  Applications should be submitted to the Managing Agent.   The board have prepared guidelines for the use of residents considering making alterations to their property.

Working with Contractors

If you’ve engaged contractors to work on your property, then they’ll need permission from the Managing Agents to enter the Garden and will be required to pay a security deposit.  The only vehicles allowed into the Garden are those belonging to contractors employed by Formosa Amenity. A copy of the regulations which apply when tradesmen have access to the gardens, including an application form for access can be downloaded from the website.  Please ensure that tradesmen you engage receive a copy of these regulations and have read them.  No scaffolding may be erected or dismantled over weekends and building work which will create any disturbance must only be carried out between 8am and 6pm during the week and 8am and 1pm on Saturdays.  No work is permitted on Sundays.

Children and Games

Children can have great fun in the garden but parents or guardians are asked to be responsible for their children at all times and ensure that they don’t play in or disturb the beds.  Football, cricket or other games may only be played by children or children with adults in small groups.  Hard balls such as cricket and golf balls may not be used in the garden by anyone. Kites and model aircraft are not allowed and stone throwing is forbidden.

Parties & Barbecues

If you’re planning a private party and have invited more than ten guests then you’ll need prior permission from the Formosa Amenity. We also don’t allow any private fires, barbeques or bouncy castles in the communal areas. Please contact the Managing Agents for further details and permission.  Please do ensure you and your visitors take all your rubbish and litter home.

Noise & Music

Please keep noise levels down and be respectful of those who live around you.  That goes for any loud music, speakers, musical instruments or machinery of any kind which might cause annoyance to your neighbours.

Animals

A number of animals enjoy the Garden with us, so we’ve created a few rules to ensure they play safely too.  Animal owners are required to control their pets and dogs now need to be registered on the Formosa Amenity website.  Residents’ dogs are permitted in the Garden if they have been registered and are kept on a lead.  Dogs are permitted to be let off the lead only from daybreak to 9am in summer (BST) and daybreak to 10am in winter. Dogs must not foul the Garden.  Any dog banned or should be muzzled under the Dangerous Dogs Act can’t come in.

Gates & Keys

We’ve installed a new electronic gate to allow easier and more secure access to the Garden. For security reasons, the Garden gate must be kept closed at all times and keys must not be transferred or loaned to others including contractors.  Anyone who leaves the garden gate open and unattended will be fined.  Anyone who props open the garden gate and damages the motor will be fined up to £2000, at the absolute discretion of the Board.  Residents, freeholders and leaseholders will be held responsible for the actions of anyone they allow into the garden.

Bicycles

For safety reasons, bicycles and other personal toys must be removed from the Garden no later than dusk each day, failing which they will be removed.

Fireworks

Except for the annual November display organised by Formosa Amenity, fireworks are not permitted under any circumstances.  Use of rockets and fireworks, even in private gardens, is strictly forbidden.

Laundry

None of us may dry laundry out of doors.

What happens if you break the rules?

The breach of any of these rules may result in a penalty, the nature and extent of which will be determined by Formosa Amenity. In addition, all owners of property adjoining the Gardens when purchasing their property committed to abide by the terms of the  Rentcharge Deed.
